Terms and Conditions of Sale
Except as otherwise expressly provided in other specific provisions, the terms listed below shall have in these Terms and Conditions of Sale, the meaning ascribed to them in the following definitions:
“Business Day” or “Business Days” means the days on which our offices are open for normal business (generally every day from 9 a.m. to 5 p.m. excluding Saturdays, Sundays, UK calendar holidays, also known as BANK HOLIDAYS).
“Force Majeure Events” include situations resulting (directly or indirectly) from any strikes, lockouts, fires, floods, proven inability to procure products, materials or services, breakdowns, delays by suppliers or couriers, government laws or regulations, or any other cause or event beyond our control. The above is provided for illustrative purposes only. There are other events that may be of a force majeure nature.
These General Terms and Conditions of Sale have as their object the purchase of products on antoniobiggio.com made remotely via computer network on the site “www.antoniobiggio.com”. These purchases are reserved for Customers direct users, traders, wholesalers, retailers, professionals, etc.. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and , as regards the protection of confidentiality, will be subject to the regulations of Legislative Decree no. 196/03.
ACCEPTANCE OF THE ORDER / CONCLUSION OF THE CONTRACT
By sending the order online, the Customer transmits to our site a proposal to purchase the product and/or products placed in the cart. When the Customer places an online order for the products he/she has placed in the shopping cart, he/she agrees to purchase them at the price and under the terms indicated in these General Terms and Conditions of Sale.
Our site will send the Customer an e-mail of acceptance and confirmation of the order containing the number, date and total amount of the order. If, for any reason, we are unable to accept the Customer’s order (for any of the cases set forth below), we will immediately notify the Customer via the site.
In particular, orders will not be accepted:
if the material, at the time of the order, is not in stock
if the issuer of the Customer’s credit card does not confirm the payment.
However, Antoniobiggio.com reserves the right not to accept the order, at its discretion.
These General Conditions of Sale must be reviewed online by Customers before sending their orders. The placing of the order therefore implies their full knowledge and acceptance.
The Customer undertakes and is obliged, once the online purchase procedure is concluded, to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out, in order to fully satisfy the condition set out in Articles 3 and 4 of Legislative Decree no. 185/1999.
The prices shown on this site are the sales prices currently in effect. In the event that the price of the goods ordered is reported in a clearly discrepant manner, the order may be cancelled at any time by us or by the Customer, provided that before the goods are sent, and it will be possible to reorder the products at the correct selling price.
Payment for the purchased products and related shipping costs must be made by the customer when placing the order through the use of one of the credit cards available and indicated online, or through PayPal. Antoniobiggio.com is not responsible for any fraudulent and illegal use that may be made by third parties of credit cards when paying for products purchased.
In case of acceptance of the order it is specified that:
for orders accepted on the site before 2:00 p.m. on a business day, the shipment of goods will normally take place on the same day;
for orders received after 2 p.m., the goods will be shipped the next business day;
if the order was placed on a non-business day, the goods will in any case be shipped on the first next Business Day.
Exceptions may occur in case of Force Majeure Events.
Goods will be delivered via a courier service to your home. Shipment is defined as the delivery of the goods to the courier. Delivery times described during the purchase process on the site depend on the shipping method used, depending on the weight and size of the items purchased. The courier will deliver the goods only against a signature confirming receipt of the goods.
In the event that the goods, shipped by courier, do not arrive by the deadline, the Customer may contact us through this form.
In the event that the goods have not been delivered due to the Customer’s inability to receive them, the Customer should first contact the courier company through the references that are left by the courier company itself for cases of non-receipt of goods and, in the event that this operation is not possible, give us notice and we will see how best to solve it.
LIABILITY FOR LATE DELIVERY
If the shipment of the goods does not take place within the agreed time or the courier in charge does not deliver the goods within the expected delivery time, antoniobiggio.com will contact the Customer as soon as possible and, according to the needs of the latter, will try to establish another delivery date.
In the event that such an agreement cannot be reached, the Customer will be refunded the full amount paid.
If prompt delivery is essential, the Customer is advised to purchase the products sufficiently in advance.
RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, if the Customer is a consumer (i.e. a natural person who buys goods for purposes not related to his business or professional activity), he has the right to withdraw from the purchase contract for any reason, without explanation and without penalty.
To exercise this right, the customer must contact the support service indicated on the site, follow the instructions that the operator will provide him/her with and send a communication to that effect, within 10 working days from the date of receipt of the goods.
Once we receive such notice of withdrawal, we will quickly notify the customer of the details on how to return the goods.
As the sole burden, and if the error was not due to a fact attributable to us, the Customer shall bear the cost of returning the goods.
The goods must be returned unused, undamaged and in the original packaging, complete with all its parts and without having suffered any damage.
Upon arrival at the warehouse, the goods will be examined and, if there is any damage or tampering, the withdrawal cannot be exercised.
We will then refund the customer the full amount already paid within the terms of the law. The refund will be made by re-crediting the amount due to the credit card, bank account or PayPal card used by the customer to purchase the item.
It will be the Customer’s responsibility to promptly provide us with any information necessary for a correct and prompt refund procedure.
Any complaints must be made directly through this site. We undertake to respond to complaints within five business days.
